* **Matter:** Petition under **Section 86 of the Electricity Act, 2003** read with **GERC Conduct of Business Regulations, Gujarat Renewable Energy Policy 2023** & **Tariff Order dated 31.08.2024** seeking:

* Extension of time for commissioning of evacuation line, bays, and metering system for **4.15 MW Solar–Wind Hybrid Project**.

### **2. Petitioner’s Submissions**

* GETCO executed Bulk Power Transmission Agreement on **09.04.2025** for 2.48 MW.
* Provisional agreement signed on **15.04.2025** for 2.48 MW.
* Delay caused by **Right of Way (ROW) issues** with farmers.
* Delay in finalising **Format-6 agreement** for 3 months due to mandatory agreements among lead generator and other generators.
* Project commissioned on **27.05.2025**.
* Other generators: Gokulanand Petro Fibres & GTX Pvt. Ltd. (not impleaded as parties).
* Bank Guarantee issued on **15.11.2023**, expiring **01.12.2025** (claim period till **01.12.2026**).

### **3. Respondent’s Submissions**

* Format-6 compliance was **sole responsibility of Petitioner** as per Connectivity Procedure.
* Stage-II connectivity granted on **30.12.2023**; Petitioner responsible for approvals from Govt. of Gujarat.
* ROW clearance for 3 towers obtained only on **15.06.2024**, **20.06.2024**, and **07.12.2024**; Petitioner did not start work until June 2024.
* Detailed Procedure allows **18 months** to complete work.
* Petitioner has not disclosed dates of approaching Govt. for approvals and has not substantiated ROW delay claims.
* Petitioner was **lead generator**; delay would impact others as well.

### **4. Commission’s Observations & Directions**

* Petitioner sought time to file rejoinder — allowed **4 weeks** (copy to Respondent).
* Respondent may file reply within **3 weeks** thereafter (copy to Petitioner).
* Directed parties to complete pleadings before next hearing.
* Next hearing date to be intimated separately.
