* **Force Majeure Grounds Cited:**

1. Delay in **GEDA project registration** and **Development Permission** (July 2023–Aug 2024).
2. **MoD “No WTG Zone” notification** delayed No Objection Certificate (NOC) for transmission line.
3. Frequent **changes in GIS bay sequence** by GETCO & other RE developers.
4. **Tariff vacuum** from Apr 2022 to Aug 2024 caused regulatory uncertainty and deterred investors.
* Stage-II connectivity granted on **27.06.2023** with SCOD of **26.12.2024**; requests 1-year extension.

### **3. Respondent’s Submissions**

* Many delays were due to Petitioner’s own **late applications** and **commercial decisions**.
* GEDA permissions could have been applied for earlier.
* MoD NOC application filed late (June 2024) despite Petitioner’s prior knowledge of restrictions.
* Changes in bay sequence were partly at Petitioner’s request and due to its own delay in submitting drawings.
* Tariff gap issue is commercial, not Force Majeure, and was known before project initiation.
