### **4. Commission’s Observations & Directions**
* Petition is maintainable under Sections 62 & 86(1)(a); GSECL is a generating company and GUVNL a licensee – Commission has jurisdiction.
* Directed Petitioner to:
* Issue **public notice** in 2 Gujarati + 1 English newspapers inviting stakeholder comments within 30 days.
* Upload petition & documents on website.
* File compliance affidavit with copies of published notices.
* Commission staff to:
* Upload petition on GERC website.
* Forward received objections to Petitioner & notify objectors for hearing.
* Respondent (GUVNL) to file reply within **4 weeks** (copy to Petitioner).
* Petitioner may file rejoinder within **3 weeks** thereafter (copy to Respondent & objectors).
* On interim tariff request: Commission ruled that **parties must act as per PPA terms** for payments.
