### 📘 **Purpose of the Rules**

These draft rules are proposed under the **Energy Conservation Act, 2001**, to ensure proper **compliance enforcement** of energy efficiency obligations across industries and sectors. The aim is to:

* Promote energy conservation
* Enable **Bureau of Energy Efficiency (BEE)** to detect, verify, assess and represent non-compliance
* Set clear mechanisms for **reporting**, **verification**, **jurisdiction**, and **penalties**

### 🧾 **Key Provisions**

#### 1. **Title & Commencement**

* Official Name: *Energy Conservation (Compliance Enforcement) Rules, 2025*
* To come into force upon final publication in the Official Gazette.

#### 2. **Applicability**

Applies to:

* Entities mentioned in **Section 13A** (energy-intensive industries, buildings, transport etc.)
* **Manufacturers/importers** under Section 14(c)
* **Designated consumers** under Sections 14(e), 14(n), and 14(x)
* Any other person or entity covered under the Act

#### 3. **Norms & Standards**

* BEE is responsible for enforcing compliance with energy norms/standards prescribed by the **Central Government**
* In case of a shortfall, **Central norms will override** State-level ones
* Penalty will be imposed in case of **underachievement** (failure to meet energy-saving targets)

#### 4. **Reporting Obligations**

Entities must report compliance related to:

* Sections 13A and 14 (various subsections)
* Reports must be submitted **periodically** to BEE

#### 5. **Verification**

BEE will:

* Verify compliance
* Submit certification reports to the Central Government

#### 6. **Jurisdiction & Penalty Adjudication**

Adjudicating Officers appointed by **State Electricity Regulatory Commissions (SERCs)** will handle non-compliance cases, as per location of:

* Manufacturer’s HQ (for appliances/vehicles)
* Industrial establishment (for designated consumers)
* Holding company HQ (for holding-level compliance)

#### 7. **Penalty Distribution**

* Collected penalties will go to the **Central Energy Conservation Fund (CECF)**
* Distribution:

* **90%** to respective **State Consolidated Funds**
* **10%** retained by the Central Government

#### 8. **Enforcement & Representation**

* BEE or its designated agencies will:

* **Serve notices** to non-compliant entities
* **Represent cases** before adjudicating officers
* **Authorize officers or legal reps** for proceedings

#### 9. **BEE’s Role**

BEE will:

* Develop **implementation regulations**
* Issue detailed **guidelines** for stakeholders

* Objections/suggestions to be sent **within 30 days** of publication
