Summary:

## **Case Summary**

**Forum:** Gujarat Electricity Regulatory Commission (GERC), Gandhinagar
**Petition No.:** 2466 of 2025
**Date of Order:** 21 July 2025

### **Parties**

* **Petitioner:** Surya Roshni Ltd.
*Represented by:* Mr. Kalpesh B. Ramjiyani & Mr. P.R. Thukral

* **Respondent No. 1:** Paschim Gujarat Vij Company Ltd. (PGVCL)
*Counsel:* Adv. Ms. Shrishty Khindaria with Mr. S.N. Parmar & Mr. J.R. Bavalia

* **Respondent No. 2:** Gujarat Urja Vikas Nigam Ltd. (GUVNL)
*No appearance*

### **Nature of Petition**

Filed for **clarification** on the applicable provision of regulation for a **Grid Interactive Rooftop PV Solar Project** commissioned on **11 May 2022** — before publication of GERC (Net Metering) Third Amendment Regulations on **31 May 2022**.
Petitioner seeks confirmation that the project should be governed by the earlier Net Metering Regulations, 2016 (with Second Amendment, 2020), and that **banking charges** under the later amendment should not apply.

### **Petitioner’s Key Submissions**

1. **Project Timeline & Agreement:**

* Registered: 14 Feb 2022.
* Commissioned: 11 May 2022 (750 kW AC / 951.6 kW DC capacity).
* Provisional interconnection agreement signed 07 May 2022 awaiting regulatory amendment to align with Gujarat Solar Policy, 2021.

2. **Regulatory Position:**

* On commissioning date, only **Net Metering Regulations, 2016 + Second Amendment (2020)** applied.
* Third Amendment (31 May 2022) was **prospective**.
* Requested final interconnection agreement under pre-amendment rules.

3. **Charges Dispute:**

* PGVCL charged **Rs. 42,98,259** as banking charges (period: 11 May 2022 – 31 Dec 2024).
* Petitioner claims these charges are inapplicable for projects commissioned before Amendment 3.

4. **Relief Sought:**

* Clarification that Amendment 3 does not apply.
* Direction to PGVCL to sign final agreement without banking charges.
* Refund of banking charges collected so far.

### **Respondent No. 1’s Position (PGVCL)**

* COD: 11 May 2022; agreement signed 07 May 2022.
* Relied on **GERC Order dated 11 June 2021 in Petition No. 1396 of 2021** (incorporating Gujarat Solar Policy, 2021) — which allowed recovery of banking charges.
* Argued that this order pre-dated project commissioning and justified the charges, regardless of later amendment timing.
* No coercion alleged in signing agreement; charges per agreed terms.

### **Petitioner’s Counter**

* If PGVCL’s interpretation applies, then by same logic, **GoG RE Policy 2023** should now apply from its start date.
* Argued that the 11 June 2021 order’s net metering provisions were inapplicable to this case; instead, Second Amendment rules governed.
* Requested time to file written submission addressing respondent’s reply.

### **Commission’s Directions**

* Both parties may file **written submissions within 4 weeks**, sharing copies with each other.
* Matter **reserved for order** after receiving submissions.

**Coram:**

* Shri S.R. Pandey, Member
* Shri Mehul M. Gandhi, Member
