### **1. Case Background**

* **Matter:** Petition under **Section 62 read with Section 86(1)(a)** of the Electricity Act, 2003 for **determination of tariff** for **40 MW Solar PV Grid-connected Power Projects** at Haripar, District Jamnagar, established by GSECL.

### **2. Petitioner’s Submissions**

* The project became operational in **four phases**:

1. 10 MW – 25.04.2022
2. 10 MW – 14.06.2022
3. 10 MW – 28.06.2022
4. 10 MW – 12.07.2022
* Requested **interim tariff @ 95%** of the claimed tariff as an interim arrangement to cover O\&M and obligations, subject to adjustment after final tariff determination.
* Agreed to submit supporting documents within **two weeks**, including:

* EPC, civil, and O\&M contracts
* Loan agreements and financial arrangements
* Board resolutions on equity
* Copy of PPA and technical details
* Agreed to issue **public notice** inviting stakeholder comments/suggestions.

### **3. Respondent’s Submissions**

* Requested time to file a reply in the matter.

### **4. Commission’s Observations & Directions**

* **Jurisdiction:** Confirmed under Section 62 and Section 86(1)(a) of the Electricity Act, 2003.
* **Public Notice:** Directed Petitioner to publish in **two Gujarati newspapers** and **one English newspaper** with wide circulation, and upload the petition and documents on its website. Stakeholders to file comments within **30 days** of notice.
* **Document Submission:** Petitioner to file compliance affidavit with copies of published notices.
* **Respondent’s Reply:** Due within **4 weeks** (copy to Petitioner).
* **Petitioner’s Rejoinder:** Due within **3 weeks** after receiving Respondent’s reply (copy to Respondent).
* **Stakeholder Participation:** Commission staff to forward stakeholder comments to Petitioner and issue hearing notices to objectors.
* **Interim Tariff Request:** Directed both parties to act per terms of PPA regarding payments for supplied energy — no provisional tariff granted at this stage.

### **5. Outcome**

* Procedural order — sets timelines for public notice, document submissions, replies, and rejoinders.
* Interim relief request deferred; parties to follow existing PPA payment terms.
* Next hearing date to be notified separately.
